These Terms and Conditions (hereinafter, "TyC") regulate the legal relationship derived from the contracting processes formalized by the clients who contract the services (hereinafter, the "Clients") through the website www.coverai.pro (hereinafter, "Website").

The Irish company Longstone Mobile Ltd S.L. (Hereinafter "CoverAI"), with VAT - IE04170949LH, with address at 71 Lower Baggot Street, Dublin, Ireland is the owner of the Website. CoverAI has the contact email address info@coverai.pro.

CoverAI provides the service described in section 3 of these T&Cs (hereinafter, the "Service"), which can be contracted through the Website.

2. Acceptance and scope of application

The conditions established for the provision of the Service in accordance with these Ty C will be applicable when the Client has the status of consumer by virtue of the provisions of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws (hereinafter, "LCyU"). 3. Service Description

The service provided by CoverAI consists of the possibility of creating in real time cover letters for a person, based on answers previously given to a questionnaire asking about the purpose and characteristics of the letter. The crafting process is assisted by artificial intelligence, to ensure quality in the cover letter delivery.

For the provision of the Service, it is necessary for the Client to have Internet access to contract the Service, and to communicate valid information in the previously mentioned questionnaire.

4. Age and veracity of the information provided

The Client declares that he is of legal age, that he has read, understands and fully accepts the T&C and that he has the necessary legal capacity to be subject to these T&C. The Client declares that all the information that he provides to access the Service, before and during its use, is true, complete, exact and precise.

The Client acknowledges that he has had full access to the T&C prior to the beginning of the Service subscription procedure, and that he has had the possibility of storing and/or reproducing them on a durable medium.

5. Intellectual and industrial property

All intellectual and/or industrial property rights related to the contents of the Website, as well as any element affected by the provision of the Service and/or infrastructure used to provide the Service are the property of CoverAI or its third parties, unless otherwise indicated. otherwise. The fact that CoverAI gives the Client access to its services does not imply any waiver, transfer, total or partial assignment of the intellectual and industrial property rights by CoverAI and does not entitle the Client to any use of the Website that exceeds the actions necessary to visit the Website and to use the Service offered through it. The User shall refrain from reproducing or copying for private use any content of this website that may be considered subject to the protection of intellectual or industrial property rights.

6. Price of the Service

To subscribe to the provision of the Service, the Client must follow the process steps indicated on the Website. The Client will complete all the fields to identify himself and choose the Service and the payment methods that are desired. The prices of the plans offered by CoverAI are shown in euros (€) and include the applicable value added tax (VAT) where applicable.

The corresponding prices and charges will be applied to the Service according to the rates in force at any time and that will be published and accessible through the Website, without prejudice to the application of offers or promotions in force at any time. Any modification of the rates will be communicated to the Client by any means that CoverAI deems appropriate so that the Client is aware of such modification and of the new rates.

7. Payment methods and billing

The Website uses a secure payment system through a provider specialized in online payment security which complies with PCI Data Security Standard requirements. This system guarantees the total confidentiality of your banking information. CoverAI guarantees that you have the necessary authorizations to use the payment method when placing the order. The credit card transaction between the Client and the secure system is fully encrypted and protected. This means that your credit card number is never fully revealed to CoverAI. The cardholder is responsible for transactions through the Website. The first payment occurs at the end of the trial period of the promotional offer in accordance with the provisions of section 13 of the T&C.

The Client may request an invoice from CoverAI for each monthly subscription period contracted by the latter and will make it available to the Client through the private area of ​​the Website, which the Client may access by using a personal password. 8. Validity of rates and offers

CoverAI reserves the right to make changes to the Service as it deems appropriate, and to update the Service according to the market. However, CoverAI undertakes to respect the conditions in force at the time of subscription of the service by a Client for the period of the current billing cycle. Regarding the prices that appear on the website, CoverAI reserves the right to modify them unilaterally, and must notify the Client prior to the automatic renewal of the monthly subscription.

9. Guarantees

CoverAI guarantees you all the rights you may have recognized in accordance with the laws in force at any time, especially with regard to consumer protection. The Client declares to understand that: a) geolocation requires the express consent of the recipient and; b) that even with your consent, the state of technology does not guarantee that your location will always be obtained or that it can be done with sufficient accuracy. In any case, and to the extent permitted by law, CoverAI reserves the right to reject, suspend or cancel the provision of the Service when the Client has failed to comply with any provision of the T&C and, very specifically, although without limitation , of the commitments on good use of the Service regulated in section 10 of the T&C.

10. Commitment to good use of the Service

The Service is offered to you exclusively as an end Client and for legitimate use, within the limits established by the laws in force at any given time and based on good faith.

To use the Service, the Client declares under his own responsibility that:

a) He is providing information for him or herself, and that has the right to do so;

b) that he does not intend to use the Service for any illegal purpose.

In particular, the Client declares to be aware that, without limitation, it is not allowed to use the Service:

Contrary to Irish laws and/or those applicable in each case.

That infringes the rights of third parties or the proper use of the Service that are only for personal and particular use of the Client, being responsible for controlling access to them.

The collection and/or use of personal data of third parties without their express consent, or contravening the provisions of current regulations on the Protection of Personal Data.

The resale of traffic or the Service, the commercialization or economic exploitation of the same by any means or system.

Obtain the consent of the recipient whose location will be tracked through coercion and/or deception.

In the event that the Client breaches any of the obligations established in this section, CoverAI will be empowered to terminate the contractual relationship with the Client with immediate effect and/or temporarily block the affected Services until the circumstances of the irregular use of the Service are clarified.

11. Responsibility

Unless there is an imperative rule that provides otherwise, CoverAI will not be responsible for any loss of data or programs as a result of the use of the Service.

Likewise, the Client undertakes to make use of the Service in accordance with these T&C. Consequently, the Client will be responsible for any damage that may be generated by a use of the Service contrary to these T&C.

12. Security

CoverAI guarantees the security of the Service in accordance with current technological knowledge. However, CoverAI cannot guarantee the complete security of the Service, although it undertakes to remedy and implement the appropriate corrective measures to correct any possible security breach as soon as possible. The Client agrees to notify the Service, immediately and via email to the address info@coverai.pro of any loss of information, access or unauthorized use by third parties or any situation that may result in the identity theft of other users. CoverAI will not be liable for any damage that may occur when using the Service if it is the result of unforeseeable technical problems or, if foreseeable, unavoidable. In the same way, CoverAI will not be responsible when the defective or erroneous action of the user, be it the sender or the recipient of the message, causes damage.

13. Subscription and refund

When contracting the Service, CoverAI offers a trial period for 72 hours at a promotional price that will be published on the Website (hereinafter, the "Trial Period"). At the end of the Trial Period and unless the Customer has subscribed to the Service, the subscription will be renewed automatically for monthly periods and without commitment to stay, at a cost of the Service in accordance with the rates indicated on the Website, without prejudice to the possibility of applying discounts derived from promotional offers that proceed in each specific case.

Consequently, and unless the Client proceeds to cancel his subscription prior to the start of a new monthly period, the Client expressly authorizes CoverAI to charge the amount on the first day of the start of a new monthly Service subscription that corresponds to the provision of the Service during said monthly payment . For the purposes of clarity, it is hereby stated that the provision of the Service obliges CoverAI to keep the Client's account open as well as the servers of the Website in order to be able to facilitate the access to the cover letters generated by the Client. The Client declares to know that the lack of use of the Service is not sufficient cause for the Client to obtain a refund of the amount paid for it.

Payments made for each month in progress already started are not refundable, except in the cases provided for in the event of withdrawal (section 14 of the T&C) or the application of a mandatory rule in force.

In the event of a refund, the Customer will be refunded by the same payment method used for the initial order. CoverAI is not responsible for reimbursement delays or errors in the event of a change in the Customer's bank details in relation to those provided when contracting the Service subscription that the Customer has not previously or simultaneously communicated to CoverAI. to request a refund.

14. Right of withdrawal

All purchases made on the Website are governed by the provisions of the LCyU regarding distance contracting. In particular, the Customer has the right to withdraw unilaterally and without giving any reason from the purchase of a Service subscription, without incurring any penalty or charge, within 14 (fourteen) calendar days following the date on which it was made said subscription effective. The withdrawal period will expire fourteen calendar days from the date of subscription to the Service.

Regardless of this, the Client may freely use the proposed form or any other type of unequivocal statement (for example, sending a letter by post or email) in which he indicates his decision to withdraw from his subscription. In all cases, CoverAI will promptly confirm receipt of said withdrawal notice by email.

CoverAI will accept the cancellation of the subscription due to withdrawal provided that said right has been exercised in accordance with the terms and conditions mentioned above.

When the Client has correctly exercised the right of withdrawal and a subscription period is in force for which the Client has paid some amount, CoverAI will reimburse the Client, the full amount charged to the Client for the period of provision of the Service in force at that time. . Example: if the customer had paid N euros for a monthly subscription to the Service on April 1 and withdraws from them on April 10, CoverAI will reimburse N euros corresponding to the current subscription period.

The reimbursement will be carried out within a maximum period of 7 calendar days from the date on which the Client has been notified of their desire to withdraw.

15. Customer Service Center and after-sales service

Without prejudice to the different means of communication referred to in these T&Cs, CoverAI makes a Customer Service Center available to the Customer that can be accessed by email at info@coverai.pro.

Through the Customer Service Center, the Customer can manage any incident, resolve doubts or manage their subscription in relation to the Service.

16. Termination

Without prejudice to the exercise of the right of withdrawal, the Client can cancel his subscription to the Service whenever he wishes, and will continue to have access to it until the end of the current monthly billing period. The Customer must notify their desire not to renew their subscription by email, through info@coverai.pro.

The termination of the subscription will be effective from the end of the current subscription period. Except as provided in relation to the exercise of the right of withdrawal, CoverAI does not make refunds or payments for partial periods of the monthly subscription.

17. Modifications and nullity

CoverAI reserves the right to modify and/or update the T&C at any time, as well as the characteristics and functions of the Service itself. If any clause included in the T&C is declared, totally or partially, null or void, it will only affect the provision in question or the part that is null or void. The rest of our T&C will remain in force and the provision in question, or the affected part of it, will be considered excluded.

18. Protection of personal data

The provision of the Service entails the processing of personal data of the Client, which will be treated in accordance with the provisions of this clause and the Privacy Policy.

We will also process your contact data in order to enable the Client's access to their private area, which can be accessed through the web.

The data that we can process for this purpose are those related to the contractual relationship itself, that is, identification data, contact data, rate data, contracted services, consumption and use of the Service, billing and payment data, including means of payment and invoices issued.

The basis of legitimacy to treat these data is in the execution of the contractual relationship, keeping them while it remains in force and after that we will keep them blocked available only to police or judicial authorities until the prescription of legal obligations and responsibilities derived from the treatment, This period is generally six years after the end of the subscription, unless there is some type of administrative or judicial claim, which will be stored until the procedure ends.

19. Applicable law and jurisdiction

The contractual relationship between the Client and CoverAI derived from these T&Cs is subject to Irish law, with the competent forum being the one that determines in each case the regulations on the protection of consumers and users.

In the event that the regulations on consumers and users do not determine the competent jurisdiction and/or are not applicable to the assumption of a specific fact, the Parties irrevocably submit to the exclusive jurisdiction of the courts of the city of Dublin in relation to any legal action or procedure that is adopted or initiated in relation to the application and/or interpretation of these T&C, and waive any opposition to any procedure in said courts that is based on the lack of jurisdiction or territorial competence.
